Terms
Plain terms for a private pilot. Using Sunny means agreeing to them.
The short version. Sunny drafts, you send. You stay the licensed agent and everything that goes out under your name is your responsibility. The pilot is free, it is early, and either of us can walk away at any time.
Who you are agreeing with
H2N LLC, doing business as Sunny. "We" and "us" mean that company. "You" means the person using the service.
The pilot
Sunny is in a private pilot. It is free, it is by invitation, and there is no minimum term. That also means there is no service level, no uptime promise, and features may change or disappear. We may end the pilot, or your access to it, at any time. You can stop whenever you like by texting STOP or emailing us.
What Sunny does
Sunny drafts client replies, tracks deadlines and contingency dates, logs showings from voice notes, and keeps records of your deals. It works by text message.
What Sunny will not do
- It does not send anything as you without your approval. Drafts are shown to you and go out only when you say so, against the exact words you read.
- It does not price your listing, negotiate on your behalf, or talk to your client directly.
- It does not give legal, tax, financial or brokerage advice, and nothing it writes is a substitute for your own professional judgement or your broker's.
What stays yours
You are the licensed professional. Sunny is a drafting tool, and a draft is not a decision.
- Everything sent under your name is yours. You read it before it goes; once it goes, it is your message.
- Fair housing is yours. Sunny flags language that reads as steering and offers an alternative, but it can miss things, and the choice of what to send is always yours. Compliance with fair housing law and with advertising rules is your obligation, not ours.
- Your licence and your brokerage rules are yours. If your broker requires supervision, retention or approval of client communication, you are responsible for meeting that.
- Your clients' information is yours to share. Only send us what you have the right to send.
It can be wrong
Sunny is built on language models. It will sometimes be confidently wrong: a date, a number, a name, a claim about a property. Check anything that matters before you act on it or send it. Treat a Sunny draft the way you would treat a draft written by a capable assistant on their first week, which is to say, read it.
Your account
Access is tied to your phone number. Keep your phone secure, since anyone holding it can text Sunny as you. Tell us straight away if you lose it. Do not share your access with someone else, and do not use Sunny for anyone else's deals without telling us.
Acceptable use
Do not use Sunny to break the law, to harass anyone, to send bulk unsolicited messages, to discriminate, to impersonate someone, or to get around the approval step that makes the whole thing safe. Do not try to break into the service or into other people's data.
Connected accounts
If you connect Google, you are authorising Sunny to use your calendar and to send mail as you, within the permissions you granted. You can revoke that at any time, from your Google account or by asking us. Those accounts remain governed by Google's own terms.
Messaging
Sunny works over SMS and iMessage. Message and data rates from your carrier may apply. Text STOP to stop, HELP for help. By using Sunny you consent to receive messages from it, including the reminders you asked for.
Your data
You keep ownership of what you send. You grant us permission to process it in order to run the service, which is described in the privacy page. We do not sell it and we do not use it to advertise to you.
No warranty
The pilot is provided as it is, without warranties of any kind, express or implied, including fitness for a particular purpose. We do not promise it will be available, accurate, or uninterrupted.
Limit of liability
To the fullest extent the law allows, H2N LLC is not liable for indirect, incidental or consequential damages, or for lost profits, lost deals or lost data, arising out of your use of Sunny. Because the pilot is free, our total liability to you is limited to one hundred US dollars.
Nothing here limits liability that cannot be limited by law.
Ending it
Either of us can end this at any time, for any reason. When it ends we delete your data on the schedule in the privacy page. Ask and we will delete it sooner.
Changes
We may change these terms. If a change matters, we will text you before it takes effect. Carrying on using Sunny after that means you accept the new version.
Governing law
These terms are governed by the laws of the State of [STATE], without regard to its conflict of laws rules, and any dispute will be brought in the state or federal courts located there.
